Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Tournago LLC ("Tournago," "we," "us," or "our") governing your use of the Tournago mobile application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to create an account. By using the Service, you represent that you are 18 or older and able to enter into these Terms. If you add a child to a team, you represent that you are the child's parent or legal guardian, or that you are authorized team staff acting with appropriate permission.

2. The Service

Tournago helps coaches, team managers, and parents/guardians organize youth-sports teams, including rosters, schedules, RSVPs, trips, notifications, and team messaging. We may add, change, or remove features at any time.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Provide accurate information and keep it current. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. Subscriptions and billing

• Plans. Creating and running a team requires a paid annual subscription of $99 per team, per year (our founding price; the regular price is $129 per team, per year), following any applicable free trial. Each team is billed separately, and prices are shown before any applicable tax.
• Free trial. New teams may include a free trial period. If you do not cancel before the trial ends, the subscription begins and your payment method is charged.
• Auto-renewal. Subscriptions renew automatically every 12 months until cancelled. We send a reminder before each renewal. You authorize us and our payment processor to charge your payment method on each renewal.
• Cancellation. You may cancel a team's subscription at any time from within the app; cancellation takes effect at the end of the current billing period, and the team becomes read-only thereafter. Except where required by law, payments are non-refundable.
• Payment processing. Payments are processed by Stripe and are subject to Stripe's terms. Purchases made through the Apple App Store may also be subject to Apple's terms. Prices may change with notice; changes apply to subsequent billing periods.

5. Your content

You retain ownership of the content you submit, such as messages, photos, and team information ("Your Content"). You grant Tournago a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display Your Content solely to operate and provide the Service (for example, delivering your messages to your teammates). You are responsible for Your Content and represent that you have the rights necessary to share it, including any photos of others.

6. Acceptable use

You agree not to:

• Harass, threaten, abuse, or harm other users, including in team or direct messages;
• Upload unlawful, infringing, or inappropriate content;
• Access or collect other users' information for purposes unrelated to legitimate team coordination;
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems;
• Use the Service to violate any applicable law or the rights of others.

We may remove content or suspend accounts that violate these Terms.

7. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Upon termination, your right to use the Service ends; sections that by their nature should survive (such as payment obligations, disclaimers, and limitations of liability) will survive.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that notifications will always be delivered on time. Tournago is a coordination tool and is not responsible for the conduct of any team, coach, parent, or participant.

9. Limitation of liability

To the maximum extent permitted by law, Tournago and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid to us in the twelve months before the claim, or fifty U.S. dollars ($50).

10. Indemnification

You agree to indemnify and hold harmless Tournago LLC and its owners from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, or your violation of these Terms.

11. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in Pennsylvania, except where prohibited by law.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
